Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Return period: The period during which the customer may exercise the right to cancel the purchase.
Customer: A natural person who is not acting in the course of a business or profession and who enters into a distance contract with the retailer.
Day: Calendar day.
Ongoing contract: A distance contract relating to a series of products and or services, where delivery and or purchase obligations are spread over time.
Durable medium: Any means that allows the customer or the retailer to store information addressed personally to them in a way that allows future access and unchanged reproduction.
Right of withdrawal: The customer’s right to cancel a distance contract within the return period.
Retailer: The natural or legal person who offers products and or services to customers via distance selling.
Distance contract: A contract concluded between the retailer and the customer through an organised system for distance selling, using one or more means of remote communication.
Means of remote communication: Any means used to conclude a contract without the customer and retailer being physically present at the same location.
Terms and Conditions: These general terms and conditions of the retailer.
Article 2 – Right of Withdrawal
The customer has the right to cancel the contract within 30 days without giving any reason. During the return period, the customer must handle the product and its packaging with care.
If the customer exercises the right of withdrawal, the product must be returned with all supplied accessories and, where reasonably possible, in its original condition, in accordance with the retailer’s reasonable instructions.
Article 3 – Applicability
These Terms and Conditions apply to every offer made by the retailer and to every distance contract and order concluded between the retailer and the customer.
Before the contract is concluded, the text of these Terms and Conditions will be made available to the customer. If this is not reasonably possible, it will be stated before the contract is concluded that the Terms and Conditions can be viewed at the retailer’s premises and will be provided free of charge upon request.
If the contract is concluded electronically, the Terms and Conditions may be made available electronically before the contract is concluded, in a way that allows the customer to easily store them on a durable medium. If this is not reasonably possible, it will be stated where the Terms and Conditions can be accessed electronically and that they will be provided free of charge upon request.
If specific product or service conditions apply in addition to these Terms and Conditions, the above provisions also apply, and in the event of conflicting terms, the customer may rely on the provision that is most favourable to them.
If any provision of these Terms and Conditions is found to be wholly or partially invalid, the remaining provisions will remain in effect. The invalid provision will be replaced by a provision that most closely reflects the original intent.
Situations not covered by these Terms and Conditions shall be assessed in accordance with their spirit. Any ambiguities regarding interpretation shall likewise be interpreted in accordance with their spirit.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be clearly stated.
All offers are non binding. The retailer reserves the right to change or withdraw an offer.
Each offer includes a complete and accurate description of the products and or services offered, allowing the customer to properly assess the offer.
Product images are intended to represent the products accurately. Obvious errors or mistakes do not bind the retailer.
All images and specifications are indicative and cannot give rise to compensation or cancellation of the contract. The retailer cannot guarantee that displayed colours exactly match the actual product colours.
Each offer provides sufficient information to make clear the rights and obligations attached to acceptance of the offer, including:
- Any delivery costs
- How the contract is concluded
- Whether the right of withdrawal applies
- Payment, delivery and execution methods
- The period during which the price is guaranteed
- Any additional communication costs
- Whether the contract is archived and how it can be accessed
- How the customer can review and correct their details
- Available contract languages
- Applicable codes of conduct
- Optional information such as available sizes, colours and materials
Article 5 – The Contract
The contract is concluded when the customer accepts the offer and meets the stated conditions.
If the customer accepts the offer electronically, the retailer will confirm receipt electronically. Until confirmation is received, the customer may cancel the contract.
For electronic contracts, the retailer will take appropriate technical and organisational measures to secure data transmission and provide a safe online environment.
The retailer may, within legal limits, assess whether the customer can meet payment obligations. If there are reasonable grounds, the retailer may refuse or cancel an order or impose additional conditions.
The retailer will provide the customer with the following information in writing or on a durable medium:
- The retailer’s business address for complaints
- Information about the return policy
- Warranty and after sales service information
- Information listed in Article 4, unless already provided
- Termination conditions for contracts exceeding one year
All contracts are subject to product availability.
Article 6 – Returns
Customers may return products within 30 days of receipt.
The return period starts on the day after the customer receives the product.
During this period, products may only be handled to assess suitability. Used, worn or damaged items may be refused.
To request a return, the customer must notify the retailer in writing or by email within the return period.
After notification, the product must be returned within 30 days. Proof of return shipment may be required.
If the customer fails to notify or return the product within these timeframes, the purchase becomes final.
Article 7 – Return Costs
Return shipping costs are the responsibility of the customer.
Refunds will be issued as soon as possible, but no later than 30 days after the return request, provided the product has been received or valid proof of return is supplied.
Article 8 – Exclusions from Returns
The right of withdrawal does not apply to:
- Custom made or personalised items
- Clearly personal products
- Products that cannot be returned due to their nature
- Perishable or time sensitive products
- Products subject to market price fluctuations
- Newspapers and magazines
- Sealed media or software once opened
- Hygiene products once unsealed
Article 9 – Pricing
Prices will not be increased during the validity period of an offer, except due to VAT changes.
Products subject to financial market fluctuations may have variable pricing, which will be clearly stated.
Price increases within three months are only permitted if required by law.
Price increases after three months are permitted only if agreed and if the customer has the right to cancel.
All prices are subject to typographical errors. The retailer is not obliged to honour incorrect prices.
Article 10 – Product Quality and Warranty
Products must conform to the contract and meet reasonable quality expectations.
Any manufacturer warranty does not affect the customer’s statutory rights.
Defects or incorrect deliveries must be reported within 30 days.
Warranty does not apply if products are misused, altered, improperly maintained or damaged by external factors.
Article 11 – Delivery
Orders will be processed with care and delivered within 30 days, unless otherwise agreed.
If delivery is delayed or partially fulfilled, the customer will be informed and may cancel the order.
Refunds will be issued within 30 days of cancellation.
If replacement products are offered, return rights remain unchanged and return costs will be covered by the retailer.
Risk transfers to the customer upon delivery.
Article 12 – Ongoing Contracts
Customers may cancel ongoing contracts at any time with up to one month’s notice.
Fixed term contracts may be cancelled at the end of the term with one month’s notice.
Automatic renewals are restricted and subject to customer cancellation rights.
Article 13 – Payment
Payments must be completed within 7 working days, unless otherwise agreed.
Customers must report payment errors immediately.
Late payments may result in reasonable recovery costs.
Article 14 – Complaints
Complaints must be submitted within 7 days of discovery.
Complaints will be responded to within 14 days.
If resolution takes longer, an acknowledgement and timeframe will be provided.
Article 15 – Governing Law
These Terms and Conditions are governed by Dutch law, even if the customer resides outside the Netherlands.
